{"id":3063,"date":"2025-04-03T18:46:15","date_gmt":"2025-04-03T16:46:15","guid":{"rendered":"https:\/\/www.marchigian.com\/terms-and-conditions\/"},"modified":"2026-01-21T09:17:18","modified_gmt":"2026-01-21T08:17:18","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/www.marchigian.com\/en\/terms-and-conditions\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"3063\" class=\"elementor elementor-3063 elementor-1579\" data-elementor-post-type=\"page\">\n\t\t\t\t<div class=\"elementor-element elementor-element-e206a11 e-flex e-con-boxed e-con e-parent\" data-id=\"e206a11\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-733af79 elementor-widget elementor-widget-text-editor\" data-id=\"733af79\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\"><b>Withdrawal and Return Terms and Conditions \u2013 marchigian.com<\/b><\/p><p class=\"p2\"><b>Introduction<\/b><\/p><p class=\"p3\">This withdrawal and return policy is drafted in accordance with Legislative Decree 6 September 2005, no. 206 (Consumer Code), which governs the right of withdrawal for distance purchases, including those made through e-commerce sites.  <\/p><p>However, pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded for certain categories of products, particularly for:<\/p><ul class=\"ul1\"><li class=\"li3\">perishable goods or those subject to rapid deterioration (e.g., fresh or artisanal food products);<\/li><li class=\"li3\">sealed goods that are not suitable for return for hygiene or health protection reasons, if opened after delivery;<\/li><li class=\"li3\">goods made to measure or clearly personalized at the consumer&#8217;s request.<\/li><\/ul><p class=\"p2\"><b>Products Excluded from the Right of Withdrawal<\/b><\/p><p class=\"p3\">For reasons of food safety, hygiene, and preservation, on marchigian.com <b>CANNOT<\/b> exercise the right of withdrawal in the following cases:<\/p><ul class=\"ul1\"><li class=\"li3\">Perishable, fresh food products or those with a short expiration date;<\/li><li class=\"li3\">Sealed products, if the packaging has been opened or damaged after delivery;<\/li><li class=\"li3\">Products that, by their nature, cannot be returned intact or are likely to deteriorate rapidly;<\/li><li class=\"li3\">Personalized products, such as custom gift packages or items assembled upon request.<\/li><\/ul><p class=\"p3\">This means that it is not possible to return or request a refund for products that have been opened, tasted, damaged, or even partially consumed by the customer.<\/p><p class=\"p2\"><b>Residual Cases &#8211; Withdrawal Allowed<\/b><\/p><p class=\"p3\">The right of withdrawal can be exercised only for non-perishable, sealed food products that have been properly stored, provided that:<\/p><ul><li>The packaging is intact and unopened;<\/li><li>The product does not fall into one of the excluded categories above;<\/li><li>The request is sent within 14 days of delivery.<\/li><li style=\"list-style-type: none;\"> <\/li><\/ul><p>In this case, the customer must bear the return costs for the withdrawal; the refund will be made within 14 days of receipt and verification of the integrity of the products.<\/p><p class=\"p2\"><b>Checks to Perform Upon Delivery<\/b><\/p><p class=\"p1\">Upon delivery, the customer is invited to carefully check the received products, verifying:<\/p><ul><li class=\"p1\">that the packaging is intact and not tampered with;<\/li><li class=\"p1\">that the label information is readable and correct (e.g., expiration date, ingredients);<\/li><li class=\"p1\">that the product received exactly matches the order placed.<\/li><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"> <\/li><\/ul><\/li><\/ul><p class=\"p1\">These checks can be performed without opening the packaging.<\/p><p class=\"p2\"><b>How to Exercise the Right of Withdrawal (if applicable)<\/b><\/p><p class=\"p1\">The right of withdrawal can be exercised only for eligible products (non-perishable, non-personalized, sealed, and unopened) and according to the following procedures:<\/p><ul><li>The customer must send a written communication within 14 days of delivery, via email to <a href=\"mailto:orders@marchigian.com\"><span class=\"s2\">orders@marchigian.com<\/span><\/a> or by registered mail to the company address: HQ Srls \u2013 Via G. Carducci 7, 63827 Pedaso (FM), Italy<\/li><li>The communication must include: first and last name, order number, indication of the product subject to withdrawal, reason (optional);<\/li><li>The product must be returned within 14 days of the communication, at the customer&#8217;s expense, intact and in the original sealed packaging.<\/li><li>The refund will be made within 14 days of receipt of the returned product, net of initial shipping costs.<\/li><li style=\"list-style-type: none;\"><ul><li style=\"list-style-type: none;\"> <\/li><\/ul><\/li><\/ul><p class=\"p2\"><b>Products Damaged or Incorrect Upon Delivery<\/b><\/p><p class=\"p1\">In case of receipt of damaged, altered, or non-compliant products, the customer must follow the following instructions:<\/p><ul><li>The report should preferably be made within 24 hours of delivery, or as soon as possible after checking the products, via email to <a href=\"mailto:orders@marchigian.com\"><span class=\"s2\">orders@marchigian.com<\/span><\/a>.<\/li><li>The communication must include: order number, first and last name, detailed description of the problem, clear and readable photographic documentation.<\/li><li>Customer service will review the report. If confirmed, the customer will receive a refund of the amount paid. <\/li><li>The company reserves the right to request the return of the defective product, at the customer&#8217;s expense, to perform internal checks.<\/li><\/ul><p> <\/p><p><b>Package Inspection at the Time of Delivery<\/b><\/p><p class=\"p3\">At the time of delivery by the courier, the customer is required to carefully check the integrity of the package.<\/p><ul><li><p class=\"p1\">If the package appears visibly damaged, wet, opened, or altered, the customer <span class=\"s1\"><b>must accept the package with specific reservation<\/b><\/span>, writing on the courier&#8217;s receipt the statement:<\/p><p class=\"p2\"><b>\u201cAccepted with reservation for damaged package\u201d<\/b><span class=\"s2\"> (or other visible reason).<\/span><\/p><\/li><li><p class=\"p1\">In the absence of such a written reservation, any claims for transport damage <span class=\"s1\"><b>cannot be accepted<\/b><\/span>, as the package will be considered delivered intact.<\/p><\/li><li><p class=\"p1\">In case of acceptance with reservation, the customer must report the problem within <span class=\"s1\"><b>24 hours of delivery<\/b><\/span>, sending a communication via email to: <span class=\"s2\">orders@marchigian.com<\/span>, attaching detailed photographic documentation.<\/p><\/li><\/ul><ul><li style=\"list-style-type: none;\"> <\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Withdrawal and Return Terms and Conditions \u2013 marchigian.com Introduction This withdrawal and return policy is drafted in accordance with Legislative Decree 6 September 2005, no. 206 (Consumer Code), which governs the right of withdrawal for distance purchases, including those made through e-commerce sites.
